Terms of Use

1. Agreement and Acceptance

By downloading, installing, or using the Swoof application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Swoof is an iOS application designed to help users triage their photo library through swipe gestures — marking photos for deletion, adding them to albums, and comparing duplicates. The App provides both free and premium (Pro) features accessible through in-app subscriptions.

3. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial purposes.

4. Subscriptions and Payments

4.1 Available Plans

• Free Version: Basic sorting features at no cost
• Weekly Subscription: Includes a free trial for eligible users
• Annual Subscription: Reduced per-month pricing

Current prices are displayed inside the App and on the App Store at the time of purchase.

4.2 Subscription Terms

• Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel your subscriptions in your App Store account settings
• Any unused portion of a free trial period will be forfeited when you purchase a subscription

4.3 Refund Policy

Refunds are handled according to Apple's App Store refund policies. Generally, all sales are final, but you may request a refund through the App Store within the applicable refund period.

5. User Responsibilities

You agree to:

• Provide accurate information when using the App
• Use the App only for lawful purposes
• Not attempt to reverse engineer, decompile, or disassemble the App
• Not use the App in any way that could damage our servers or networks
• Not share your subscription access with unauthorized users

6. Photo Library Access

The App requires Full Access to your Photos library to provide its core functionality. By granting this permission, you acknowledge that:

• Photo and video processing happens entirely on your device
• Photos you trash inside Swoof are moved to the iOS "Recently Deleted" album — fully reversible for 30 days from within the iOS Photos app
• You are solely responsible for any decisions to delete or modify your photo library
• You should maintain your own backups (iCloud Photos, Time Machine, or a third-party backup service)

7. Intellectual Property

All content, features, and functionality of the App are the exclusive property of Swoof and its developer, and are protected by international copyright, trademark, and other intellectual property laws.

8. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We do not warrant that the App will be uninterrupted, timely, secure, or error-free. You are responsible for backing up your photo library before using the App's trash and album features.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SWOOF OR ITS DEVELOPER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF PHOTOS, DATA, OR PROFITS.

11. Modifications

We reserve the right to modify or discontinue the App or these Terms at any time. Continued use of the App after changes constitutes acceptance of the modified Terms.

12. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including if you breach these Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of your country of residence.

14. Apple App Store Terms

For users who download the App from the Apple App Store:

• These Terms are between you and Swoof only, not with Apple
• Apple has no obligation to provide maintenance or support services
• Apple is not responsible for any product warranties or claims
• Apple and its subsidiaries are third-party beneficiaries of these Terms
